Regulatory background

What the General Product Safety Regulation changes

The GPSR replaced the General Product Safety Directive on 13 December 2024. It applies to all non-food consumer products sold in the EU and Northern Ireland, through every channel, and acts as the safety net where no product-specific EU legislation applies.

Obligations that now reach non-EU sellers

  • No product may be placed on the EU market without an economic operator established in the Union (manufacturer, importer, authorised representative or fulfilment service provider).
  • The responsible operator's name, address and electronic contact must appear on the product, its packaging or an accompanying document — and on the online listing.
  • Traceability data (type, batch or serial number) and safety warnings must be provided in the language of the country of sale.
  • Online marketplaces must verify and display this information and remove listings that lack it.

What authorities can ask the Responsible Person for

  • Technical documentation, instructions, test reports and risk assessments.
  • Evidence that the product complies with applicable safety requirements.
  • Cooperation on corrective action: withdrawal, recall, consumer notification.
  • Notification through the Safety Business Gateway when a product presents a risk.
